The following terms and conditions show our commitment to our guests and represent our contract with you when you vacation rent a home. We ask you to read the points of this contract carefully.
Users are responsible for ensuring the validity of the terms and conditions included in this page. The mere use of the services on this page implies the agreement and acceptance of these terms and conditions and their future changes made prior to your stay in the apartment. It is essential to accept these conditions in order to reserve and access the apartment.
MINIMUM STAY
The minimum stay may vary depending on the accommodation and/or season (consult the detailed description of each accommodation).
PRICES
Prices are always shown in EUROS (€) and may vary depending on the time of year or special events, depending on each of the apartments. Therefore, www.malagasunapartments.com reserves the right to change them, updating them automatically on the website.
BOOKING PROCESS
Our automatic system for calculating availability and prices will allow you to choose the apartment that interests you, and immediately book it online.
Initial payment: To reserve your chosen apartment online, select it and include the information requested. In this first step, to finally reserve the apartment, a first online payment will be made by credit card, which represents 100% of the total amount. In the event that the credit card provided is not valid and said charge is not possible by www.malagasunapartments.com, a member of our team will contact you at the contact telephone number or email address that you have provided. In case of not carrying out the change of card number or if it is not possible to contact you through the contact information provided, the reservation would run the risk of being cancelled. In that case, an email will be sent to you confirming said cancellation.
Confirmation of the reservation: once the payment has been made, the reservation will be confirmed instantly and you will receive a welcome email with all the details of your reservation (reservation information, address of the apartment, information of the contact person , etc.)

ARRIVALS AND DEPARTURES
Normal entrance hours to the apartments: from 3:00 p.m. to 9:00 p.m. unless it is a SELFCHECKIN, in this case it is from 3:00 p.m. to 12:00 a.m.
Normal hours of departure from the apartments: Before 11:00 am.
Both the entry and exit times will be flexible and negotiable as long as there are no other reservations on the earlier or later dates.
The client must always notify the approximate time of arrival. It is an essential condition to notify at least 7 days before the arrival time, in this way a member of our ticket team will travel to your apartment and can wait there for your arrival, in order to avoid our guests who have to wait for us at the entrance to the building in question.
Please note that our offices close at 10:00 p.m.
-Check in person between 9:00 p.m. and 11:00 p.m. has a surcharge of €30 to be paid in cash upon arrival
-Check in person between 11:00 p.m. and 01:00 a.m. has a surcharge of €60 to be paid in cash upon arrival
-Cradle. Price: €20 per stay to be paid in cash at the time of arrival.
-Airport transfer €30 up to 4 people and €37 between 5 and 8 people

At the time of arrival, the ID or passport of the person who made the reservation must be presented.
Departures after 11:00 a.m. without the express permission of the manager, will result in the charge of one more day.
DEPOSIT or SECURITY DEPOSIT
www.malagasunapartments.com reserves the right to demand a deposit/security deposit of €199 upon delivery of the keys during check-in (this amount may vary depending on each accommodation, so we advise you to review the conditions beforehand) in the detailed description of each accommodation).
After leaving the apartment, the property will be checked to confirm that it is tidy and without significant damage or loss of items such as keys. If everything is in order, and if said deposit has been required, it will be refunded at the time of departure. In the event of loss of keys, a charge for loss of keys of €70 euros per set of keys/parking remote will be charged, which will be charged to the credit card provided.
At Malaga Sun Apartments we work from empathy and common sense. With this we want to convey to you that we will not charge, for example, minor damages such as the breakage of a plate, glass of wine, etc. However, we do ask our guests to leave the apartment tidy, remove the rubbish and leave the sets of keys where they have been informed during check-in. On very specific occasions we have had to use the security deposit. However, we hope you understand that we have to protect the interests of our owners if the property is misused.
EQUIPMENT/SUPPLIES/CLEANING
The normal costs of electricity, gas and water produced during the stay will be included in the rental price. The accommodations are cleaned before each client enters, and will be equipped with a set of sheets and towels per person.
On the day of departure, the client must leave the house in acceptable conditions of order and cleanliness.
CANCELLATIONS
Please remember that the amounts delivered as a reservation will not be refunded or transferable. malagasunapartments.com will only accept cancellations in writing by email or fax, failure to show up on the agreed date without written communication of the cancellation could result in the charge of the entire stay. Cancellations of any kind, including force majeure, will be subject to these cancellation conditions. In any case, malagasunapartments.com recommends always taking out travel cancellation insurance to avoid problems. If you cancel or modify the reservation after 30 days before your arrival or if you do not show up, malagasunapartments.com will charge the total amount of your reservation.
CHANGES OR MODIFICATIONS BY THE CLIENT
In the event that the client decides to change or subsequently modify the entry/exit dates or the number of people staying in a confirmed reservation, malagasunapartments.com undertakes to find a satisfactory solution whenever possible. However, the total price will not be modified in case you want to reduce the number of days and/or number of people the stay already reserved. In the event that a change of ACCOMMODATION is requested, the client must cancel the previously confirmed reservation in accordance with the cancellation conditions, and then make a new reservation.
CANCELLATIONS AND MODIFICATIONS BY MALAGASUNAPARTMENTS
If an accommodation cannot be occupied due to duplication of reservations (overbooking) or for unforeseen reasons and not attributable to malagasunapartments.com, it will contact the client as soon as possible and try to find an alternative, making another accommodation of the same or superior quality available. features. If the aforementioned option is not possible, or you do not accept the change or modification, the reservation will be canceled and all amounts paid will be immediately refunded. Subsequent lawsuits or claims on your part in these cases will not be admissible.
CLAIMS OR COMPLAINTS
Any claim or complaint must be communicated immediately to malagasunapartments.com in order to solve the problem. In the event that the claim can be clearly adjudicated to malagasunapartments.com, it is committed to finding satisfactory solutions for customers. In the event that this is not possible, malagasunapartments.com will search for suitable or superior accommodation at no additional cost to the client.
malagasunapartments.com will not be in any way responsible for events outside the company or that derive from force majeure or fortuitous event, such as:
– Noise caused by works near the reserved home.
– Cut off supplies outside the home.
– Elevator breakdown.

Complaints or claims will not be accepted once the departure has been made, and therefore all the right to compensation or solution will be lost.
RESPONSIBILITY
The client agrees to respect the rules of the house and especially the hours of rest, it is not allowed to use the apartments for the purpose of celebrating parties (whether they are spontaneous parties, bachelor parties, etc...). In no case is it allowed to occupy the apartment by more people than those established at its maximum capacity (except babies under 2 years of age). The client also undertakes to follow the instructions for use and maintenance indicated by the company and to respect the regulations regarding noise, garbage collection, normal consumption of electricity, water, etc...
In case of any violation of the obligations mentioned above, MALAGASUNAPARTMENTS.COM by its own criteria has the right to ask the client to vacate the apartment and the client will not be entitled to any type of financial compensation.
Neither MALAGASUNAPARTMENTS.COM nor the owner will be responsible for any direct or indirect damage that may be caused as a result of the use of the apartment, including without limitation: damage, losses after fire, theft or crime.
By booking with malagasunapartments.com you agree not to carry out dangerous, offensive, noisy, illegal or immoral activities on the property, as well as any act that could create discomfort among the neighbors. You will be responsible for paying the expenses derived from any damages caused by you or by a member of your group.
OUR WEBSITE
All descriptions and information will apply to published apartments. While malagasunapartments.com makes every effort to maintain accuracy and to check details where possible, malagasunapartments.com is not responsible for any errors or omissions that may arise. malagasunapartments.com also has the right to change information published on the website such as prices, descriptions and photos at any time. malagasunapartments.com reserves the right to update any of its conditions of use at any time in case it is required, according to the business of the company.
DISPUTE RESOLUTION
For any litigious matter or that concerns our website or any of those that depend on it, Spanish legislation will apply, being competent for the resolution of all conflicts derived from or related to the use of this website, the Courts and Courts of Malaga, Spain and, where appropriate, consumer Arbitration Courts or similar to which we are attached, at the time of the dispute. To present claims in the use of our services, you can write by mail to the electronic or physical address indicated above, and in any case you must resort to a friendly solution in the first instance.
Lost items will be kept for a period of 1 month.
Most of our properties have armored doors. It is your responsibility to ensure that the necessary precautions against theft are taken: lock the door and close all the windows when you are not at home etc.
Please make sure that your personal or travel insurance coverage (and that of your group) protects you in the event of an unfortunate accident or illness during your stay. In the unlikely event of theft or damage to persons or personal property, fire, terrorist attack, civil unrest or other circumstances of force majeure, neither the rental agency nor the owner of the apartment are responsible for direct or indirect damage suffered.
